One of the quintessential goals of the American Dream is to own land and a home, a place to raise one’s family and prove one’s prosperity. Particularly for immigrant families, home ownership is a way to assimilate into American culture and community. However, Latinos, who make up the country’s largest minority population, have largely been unable to gain this level of inclusion. Instead, they are forced to cling to the fringes of property rights and ownership through overcrowded rentals, transitory living arrangements, and, at best, home acquisitions through subprime lenders.
In Tierra y Libertad, Steven W. Bender traces the history of Latinos’ struggle for adequate housing opportunities, from the nineteenth century to today’s anti-immigrant policies and national mortgage crisis. Spanning southwest to northeast, rural to urban, Bender analyzes the legal hurdles that prevent better housing opportunities and offers ways to approach sweeping legal reform. Tierra y Libertad combines historical, cultural, legal, and personal perspectives to document the Latino community’s ongoing struggle to make America home.

"This book will draw in readers who want to explore the historical, political, economic, and social contexts of the recent foreclosure crisis for Latinos pursuing the American dream of home ownership. . . Bender does and exceptional job of investigating Mexican American experiences while opening the door for future studies of other Latino group experiences." -S. Lawson-Clark, Wake Forest University,Choice Magazine
“Nothing is more vital to dignity and wellbeing than a home of one’s own. This fine book describes Latinos’ struggles to achieve home ownership in a society that has placed obstacles in their way at every turn.”

This land is your land.....

Tierra y Libertad: Land, Liberty, and Latino Housing (Hardcover)
My people are from Tierra Amarilla, and the Olivas Homestead is in Brazos, New Mexico, hard by Tierra Amarilla, so I know these stories gathered by Professor Steven Bender. Even today, there is a sign along the road to Santa Fe south, that reads Tierra or Muerte (Land or Death). Given all the discussion in the public polity about mortgages, tax exemptions for homeowners, and foreclosures, Professor Bender has put names and faces onto these anonymous tragedies, at the micro level. Anyone familiar with the longstanding abrogation practices of U.S. treaties, especially with its indigenous people, knows that the Treaty of Guadalupe Hidalgo was observed in the breach, and is a classic example of theft, governmental perfidy, and greed. Bender's work illuminates this history, and points to longstanding public policies that have played themselves out, especially in the post-WWII period to the present. He also covers ground almost completely unplowed, by differentiating between the treatment of citizen Latinos and the undocumented. This is yet another trajectory between these related people where the commonalities are more evident and pronounced than the differences. While some of these issues seem intractable, as the current crisis may seem to many, Bender has pointed out the important issues, thoroughly discussed and vetted them, and makes suggestions that seem reasonable--whether for Latinos or all Americans. Ironically, the undocumented and Latinos generally, many of them poor, once again may save the US from its own excesses; if comprehensive immigration reform does come, as it must, it will be these communities who save the day.

Tierra y Libertad: Land, Liberty, and Latino Housing (Citizenship and Migration in the Americas)
By ernesto hernandez
An excellent read for anyone interested in the issues of the "American Dream of owning a home," citizenship, and exclusions of Latinos/as in the United States (historic and present). TIERRA Y LIBERTAD, meaning 'land and liberty' in Spanish, follows these two concepts from the nineteenth century Treaty of Guadalupe Hidalgo, to post-WWII red-lining and "white flight," to present mortgage, foreclosure, and sub-prime crises. For a book covering so much historic ground, it's an extremely accessible read, for students, policy makers, activists, or those who follow current events. Eye-catching to anyone interested in why/porque, how/como, and/y since when/desde cuando, TIERRA Y LIBERTAD clearly describes how culture, law, policy, race, and the search for profits frame the dream of owning a home. The housing and financial crisis are not independent of xenophobia and racism. The reader will leave the book with a generous understanding of so many issues of the day, such as depreciated housing markets, anti-migrant sentiments, spreading financial crisis, and thinning dreams of being "dueno de casa" (home owner).
